Personalized books, digital books, previews, and related services

These Terms of Service ("Terms") are a binding agreement between you and Carve Co., Ltd., operating the TaleCoco service ("TaleCoco," "we," "us," or "our"). They govern your access to and use of https://talecoco.com/us, our personalized-book creation tools, previews, digital products, physical products, customer support, and related services (collectively, the "Services").
By creating an account, uploading a photo, generating a preview, placing an order, or otherwise using the Services, you agree to these Terms and acknowledge our Privacy Policy and Photo & AI Policy. If you do not agree, do not use the Services.
1. Eligibility and Adult-Directed Service
The Services are intended for adults. You must be at least 18 years old and legally capable of entering into a contract to create an account, upload photos or personalization information, or place an order. Children may enjoy a completed book, but they may not create an account, submit personal information, upload images, or place orders through the Services.
If we learn that a person under 13 has directly submitted personal information to us, we may suspend the account or transaction and take reasonable steps to delete the information, subject to legal, security, fraud-prevention, or dispute-preservation requirements.
2. Your Authority to Provide a Child's or Another Person's Information
When you submit a child's name, age or age range, preferences, photo, likeness, or other personalization information, or add another person (for example a sibling, parent, or grandparent) or a pet as a character, you represent and warrant that:
- you are the child's parent or legal guardian, or you have the parent or legal guardian's permission to provide the information and authorize its processing for the requested personalized product;
- for any adult you add as a character, you have that person's permission to use their photo and likeness in the book;
- you have the legal right to use and upload every photo and other item you submit;
- your submission does not violate another person's privacy, publicity, copyright, trademark, or other rights; and
- you will not ask a child to provide information directly to TaleCoco or allow a child to independently use the account-creation, upload, preview-generation, or checkout portions of the Services.
If you are creating a book for a child who is not your own, you are responsible for obtaining any consent required from that child's parent or legal guardian before you submit the child's information.
3. Accounts and Account Security
You can sign in with a Google account or with a one-time code sent to your email address. You are responsible for providing accurate information, maintaining the confidentiality of your account and email access, and all activity conducted through your account. Notify us promptly at support@talecoco.com if you suspect unauthorized use. We may require reasonable verification before changing account details, providing access to personal information, or processing a deletion request.
4. Personalized Content You Submit
"User Content" means photos, names, text, dedication messages, instructions, preferences, messages, reviews, and other material that you submit to the Services. As between you and TaleCoco, you retain any rights you already have in your User Content.
You grant TaleCoco a limited, non-exclusive, worldwide, royalty-free license to host, copy, transmit, transform, process, and reproduce User Content solely as reasonably necessary to: (a) generate previews and personalized books you request; (b) provide safety and quality checks; (c) produce, print, fulfill, deliver, support, repair, or reprint your order; (d) prevent fraud, abuse, or security incidents; and (e) comply with law. This license includes the limited right to provide User Content to service providers acting on our behalf for those purposes. Reviews you choose to post are displayed publicly on our website, and you grant us a license to display them there for as long as they remain posted.
This license is purpose-limited. We do not obtain a general license to advertise with your child's photo, sell the photo, publish the photo, or use the photo or child-personalization information to train or fine-tune general-purpose AI models. The license ends when the relevant User Content is deleted from our systems, except to the extent a copy must be preserved for security, fraud prevention, legal compliance, dispute resolution, or backup-deletion cycles described in our Privacy Policy.
5. Photo and AI Processing
The Services use generative artificial intelligence and related image-processing tools to transform photographs and personalization instructions into illustrated characters, scenes, text, and book layouts. AI processing is performed by service providers acting on our behalf (currently OpenAI and Google). Our current practices are described in the Photo & AI Policy and Privacy Policy, which are incorporated into these Terms by reference.
TaleCoco does not use your child's photo or child-personalization information to train or fine-tune TaleCoco-owned general-purpose AI models, and we do not opt in to provider programs that use API customer inputs or outputs for general model training. Service providers may maintain limited security or abuse-monitoring logs under their own API retention controls, as described in our Privacy Policy.
6. AI Output Limitations
Generative AI is probabilistic. A generated character or scene may not perfectly reproduce a person's appearance and may contain small differences across pages, including differences in facial features, hair, clothing, body position, objects, text, or background details. Colors and dimensions may also differ between a screen preview and a printed product due to displays, paper, printing processes, trimming, binding, and color-management differences.
We use quality-control measures, but we do not guarantee that AI-generated output will be error-free or photographically identical to the source photo. If an output contains a clear production or generation defect, our remedies are governed by Section 12 below.
7. Reviewing Your Book Before Production
After payment, your full book is generated and becomes available in My Books. You are responsible for reviewing it promptly: check spelling, names, personalization choices, page order, and visible character details, and use the editing tools in My Books or contact support if something needs to be corrected. Printed books are released to production automatically on a regular schedule (see Section 11); once production has started, changes are no longer possible.
A minor stylistic difference, artistic interpretation, or expected variation inherent in AI-generated illustration or physical printing is not, by itself, a defect. We may nevertheless choose to correct or regenerate content as a customer-service accommodation.
8. Prohibited Uses and Content
You may not use the Services to create, upload, request, or distribute content that:
- sexualizes, exploits, or depicts minors in sexual or inappropriate contexts, including nude or intimate images of children;
- depicts or meaningfully facilitates unlawful violence, abuse, harassment, hate, exploitation, or other illegal activity;
- contains a child's Social Security number, government identification number, financial credentials, medical records, account credentials, or other information that is unnecessary for personalization;
- infringes copyright, trademark, publicity, privacy, or other rights, including requests to reproduce protected characters, brands, celebrity likenesses, or living artists' distinctive works (our systems may automatically decline photos or requests that appear to contain third-party characters);
- misrepresents your relationship to the child or your authority to provide the child's photo or information;
- attempts to bypass safety, moderation, access-control, rate-limit, payment, or security systems; or
- is fraudulent, deceptive, malicious, or otherwise inconsistent with the intended family-oriented use of the Services.
We may reject, block, remove, or refuse to fulfill any request that we reasonably believe violates these Terms, our policies, applicable law, or the rights or safety of any person.
9. TaleCoco Intellectual Property
The Services, including TaleCoco's software, website design, trademarks, logos, product names, underlying story frameworks, templates, workflows, interface elements, selection and arrangement of content, and other materials we provide, are owned by TaleCoco or our licensors and are protected by intellectual-property laws. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.
Subject to these Terms and payment of all applicable fees, TaleCoco grants you a personal, non-exclusive, non-transferable license to use the digital personalized book and generated materials delivered to you for personal and household purposes. You may print or share reasonable copies within your family. You may not sell, sublicense, commercially distribute, scrape, resell, or use TaleCoco-generated books or platform materials to build a competing dataset, service, model, or product without our written permission.
Nothing in these Terms gives you ownership of third-party intellectual property that may incidentally appear in a request or output. We may modify or refuse output to reduce the risk of infringement.
10. Orders, Pricing, Payment, and Taxes
Prices are shown at checkout in U.S. dollars (USD). The price of a printed hardcover book includes the digital book and standard shipping to a U.S. address; digital books are priced separately. Prices and promotions may change before you submit an order. Payment is processed by PayPal; you authorize us and PayPal to charge the payment method you select for the total amount shown at checkout. We may correct obvious pricing or technical errors before fulfillment and, if necessary, offer you the choice to pay the corrected price or cancel the affected order for a refund.
We do not currently collect U.S. sales or use tax at checkout. You are responsible for any use tax or similar charge that applies to your purchase under the law of your state. Printed books are produced in the Republic of Korea and shipped internationally to the United States; personalized children's books are generally not subject to U.S. import duties, and we do not charge customs fees at checkout. If a carrier or authority nevertheless asks you to pay an import charge, contact us before paying and we will help resolve it.
11. Production Start
For purposes of these Terms, "Production Start" occurs when your paid order is released to our printing workflow, which happens automatically on a regular production schedule after your book has been generated (typically within a few days of payment), or, for a digital personalized product, when the digital book is made available for download, whichever occurs first.
12. Cancellations, Refunds, Reprints, and Defects
Because personalized products are made specifically for you, they generally cannot be resold. Accordingly:
- Self-service cancellation (all orders): within 30 minutes after payment, you can cancel the order yourself in My Books for a full refund, provided you have not yet downloaded the PDF or image files.
- Before Production Start: after the 30-minute window, contact us promptly at support@talecoco.com or through a 1:1 inquiry. If the order has not entered production, we will use commercially reasonable efforts to cancel or modify it. We do not guarantee that cancellation will still be technically possible.
- After Production Start: change-of-mind cancellations, personalization changes, and returns are generally not available unless required by applicable law.
- Damaged, misprinted, materially defective, or incorrect physical products caused by us or our fulfillment provider: contact us within 30 days after delivery, provide your order number and reasonable evidence (such as photographs), and we will provide an appropriate remedy, which may be a reprint, replacement, correction, account credit, or refund.
- Lost or undelivered packages: if tracking shows that your package was lost in transit or was not delivered, contact us and we will send a replacement at no charge. We may ask you to confirm the delivery address before reshipping.
- Customer-approved errors: spelling, names, choices, or other errors visible in the book you reviewed in My Books ordinarily do not qualify as our production defect.
- Digital products: once a digital personalized product has been downloaded, change-of-mind refunds are unavailable. If the file is technically defective or materially inconsistent with your order, contact us and we will use reasonable efforts to repair, replace, or otherwise remedy it.
Approved refunds are returned to your original payment method; PayPal typically completes the refund within 3–5 business days. Nothing in this section limits any non-waivable rights you have under applicable consumer-protection law.
13. Shipping and Delivery
Printed books are produced in the Republic of Korea and shipped to your U.S. address by international parcel service, with final delivery by a U.S. carrier (currently USPS or GOFO, depending on your address). Tracking information is provided when your book ships. Delivery dates are estimates unless we expressly state that a delivery date is guaranteed. Delays may result from production, carrier operations, customs processing, weather, labor interruptions, incorrect addresses, failed delivery attempts, or other circumstances outside our reasonable control.
You are responsible for providing a complete and accurate delivery address, including a telephone number the carrier can use. If tracking shows a delivery problem or a package appears lost, contact customer support; as described in Section 12, we will reship a lost or undelivered book at no charge. Risk of loss and title transfer as required by applicable law.
14. Promotions, Credits, and Gift Codes
Promotions, coupons, referral credits, points, and gift codes may be subject to additional terms, expiration dates, product restrictions, geographic restrictions, or usage limits. Unless required by law, promotional value is not redeemable for cash and may not be combined, transferred, or resold except as expressly stated.
15. Third-Party Services
We rely on third-party providers for functions such as AI processing, cloud hosting, payment processing, printing, fulfillment, shipping, communications, security, analytics, and customer support. Your use of some third-party features may also be subject to the provider's terms. We remain responsible for our own obligations under these Terms, but we do not control independent third-party services outside our contractual relationship with them.
16. Privacy
Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information. Our Photo & AI Policy gives additional information about child photos, personalization data, AI processing, model-training restrictions, facial-recognition practices, and deletion. By using the Services, you acknowledge those policies.
17. Copyright Complaints
If you believe content available through the Services infringes your copyright, send a written notice to support@talecoco.com with: identification of the copyrighted work; identification and location of the allegedly infringing material; your contact information; a statement of good-faith belief that the use is not authorized; a statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the copyright owner; and your physical or electronic signature. We will review the notice and remove or disable access to material as appropriate.
18. Electronic Communications
You agree that we may send transactional communications electronically, including sign-in codes, order confirmations, security notices, service updates, policy notices, and customer-support responses. Marketing emails are sent only with your consent, and you may unsubscribe at any time without affecting transactional messages necessary to service your account or orders.
19. Suspension and Termination
We may suspend, restrict, or terminate access if we reasonably believe you violated these Terms, created safety or legal risk, engaged in fraud or payment abuse, infringed rights, or attempted to compromise the Services. Where appropriate, we may provide notice and an opportunity to cure. You may stop using the Services at any time and may delete your account yourself in My Page, as described in the Privacy Policy.
20. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES, PREVIEWS, AI OUTPUTS, AND DIGITAL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TALECOCO DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND QUIET ENJOYMENT TO THE EXTENT SUCH WARRANTIES MAY LEGALLY BE DISCLAIMED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI OUTPUT WILL PERFECTLY MATCH A PERSON OR PROMPT.
Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you. Any express product warranty or mandatory consumer warranty required by law remains unaffected.
21. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TALECOCO AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, TALECOCO'S AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TALECOCO FOR THE AFFECTED ORDER OR, FOR NON-ORDER CLAIMS, DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US$100. THIS LIMIT DOES NOT APPLY WHERE APPLICABLE LAW PROHIBITS THE LIMITATION, INCLUDING LIABILITY THAT CANNOT LEGALLY BE LIMITED.
22. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless TaleCoco and its affiliates from third-party claims, damages, liabilities, and reasonable costs arising from your User Content, your lack of authority to submit another person's or child's information, your infringement of third-party rights, or your material violation of these Terms. This obligation does not apply to the extent a claim results from TaleCoco's own unlawful conduct.
23. Events Beyond Our Control
We are not responsible for delay or failure caused by events beyond our reasonable control, including natural disasters, war, civil unrest, government action, carrier disruption, internet or cloud outages, widespread cyber incidents, labor disputes, epidemics, shortages, or failures of critical third-party infrastructure, except to the extent applicable law requires otherwise.
24. Governing Law and Consumer Rights
These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-law rules, unless mandatory law requires otherwise. Any dispute that cannot be resolved informally may be brought in a court of competent jurisdiction in the Republic of Korea, except that this clause does not waive any non-waivable right you may have to bring a claim in another forum or under the mandatory consumer-protection law of your U.S. state of residence.
Before commencing formal proceedings, we encourage you to contact support@talecoco.com so that we can attempt to resolve the issue. Nothing in these Terms prevents either party from seeking urgent injunctive or equitable relief where legally available.
25. Changes to These Terms
We may update these Terms to reflect changes in the Services, law, technology, or business practices. We will post the updated Terms and revise the Effective Date. If a change is material, we will provide additional notice where required by law. Changes do not retroactively reduce rights with respect to an order already completed unless legally permitted and appropriately disclosed.
26. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect and the invalid provision will be enforced to the maximum extent permitted. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a merger, reorganization, financing, sale of assets, or transfer of the Services, subject to applicable privacy and consumer-protection requirements. These Terms, together with policies incorporated by reference and any product-specific terms shown at checkout, form the entire agreement concerning the Services covered by them.
