Talecoco Terms of Service

1. The Service. Talecoco is a digital service that uses artificial intelligence to create a personalized children's storybook. It is currently provided as a digital eBook (PDF) that you download and/or access through your account. We may offer printed or other formats in the future; any such option would have its own terms.

2. Eligibility; adult account holder. You must be at least 18 years old and able to form a binding contract to create an account. The account holder is an adult. The Service is not directed to children and children may not create accounts. If you upload a photograph of a child, you confirm you are that child's parent or legal guardian (or are authorised by them).

3. Your content; the photographs you upload. You may upload photographs and information to generate a storybook ("Your Content"). You represent that you own or have all necessary rights and permissions to upload Your Content and to allow us to process it as described in our Privacy Notice and the related consents. You grant us a limited licence to host, process, and transform Your Content solely to provide the Service to you (create, store, and deliver your eBook) and for no other purpose. We do not use Your Content, including children's photographs, to train AI models.

4. How creation works. After you purchase, the AI generation of your personalized eBook begins. Generation, illustration, and assembly are automated and individualized to the inputs you provide. Because each eBook is generated on demand and uniquely personalized, please review the Refund & Digital Content Policy carefully.

5. Acceptable use. You must not: upload content that is unlawful, infringing, or that depicts a person without their (or their guardian's) consent; attempt to reverse engineer, scrape, overload, or disrupt the Service; resell or commercially exploit generated content beyond personal use; or use the Service to create harmful, deceptive, or abusive material.

6. Intellectual property. We and our licensors own the Service, software, templates, and brand. Subject to your compliance with these Terms and full payment, you receive a personal, non-exclusive, non-transferable licence to use the eBook you generate for your own personal, non-commercial use. You retain your rights in the original photographs you upload.

7. Purchases, pricing, and refunds. Prices are shown at checkout in US dollars (USD) and include or exclude taxes as indicated. Payment is processed by PayPal; we do not store your full card details. Refunds and your cancellation/withdrawal rights for digital content are described in the Refund & Digital Content Policy, which forms part of these Terms.

8. Availability; changes. We may modify, suspend, or discontinue parts of the Service. We aim to keep your purchased eBook available for download for as long as your account is active and until you request deletion (subject to legal record-keeping such as tax/transaction records); we recommend you download and keep your own copy.

9. Disclaimers. Except as required by law, the Service and generated content are provided "as is". AI-generated illustrations are stylised interpretations and may not exactly resemble the subject. Nothing in these Terms excludes or limits rights you have under mandatory consumer law that cannot be excluded.

10. Liability. To the extent permitted by law, we are not liable for indirect or consequential loss. Our total liability for any claim is limited to the amount you paid for the relevant eBook. This clause does not limit liability that cannot be limited by law (e.g., for death or personal injury caused by negligence, fraud, or non-excludable consumer guarantees).

11. Suspension/termination. We may suspend or close accounts that breach these Terms. You may stop using the Service and request deletion at any time (see Privacy Notice).

12. Changes to these Terms. We may update these Terms; we will post the updated version with a new effective date and, where required, ask you to re-accept material changes.

13. Governing law & disputes. These Terms are governed by the laws of the Republic of Korea; this does not deprive you of mandatory consumer protections, or the right to bring proceedings, in your country of residence.
